Traditionally, the law requires that a police officer have probable cause to pull someone over. The officer needs to observe erratic driving or something else that would lead them to believe the driver is impaired.

Obviously, this does not happen at DWI/DUI checkpoints. Police simply stop everyone. If they smell alcohol, they conduct their field sobriety tests or breath tests.
